1. License Grant
HOME OF DW LTD grants you a limited, non-exclusive, non-transferable, revocable license to access and use dwsender.com for your personal or business use, in compliance with this Agreement and any applicable usage guidelines.
- Trial License: You may access our Software on a free trial basis for 30 days. After the trial period, continued use requires a paid subscription.
- Subscription License: Upon subscribing to a premium plan, you receive a license to access the features of the Software according to the terms of your plan.
2. Ownership and Intellectual Property
The Software is licensed, not sold. HOME OF DW LTD retains all ownership, rights, title, and interest in and to dwsender.com, including all associated copyrights, trademarks, trade secrets, and other intellectual property.
- No Resale: You may not rent, lease, sell, distribute, or sublicense the Software or any of its components.
- Restrictions: You may not modify, reverse-engineer, decompile, disassemble, or create derivative works based on the Software, except as expressly permitted by law.
3. Permitted and Prohibited Uses
You agree to use the Software in compliance with applicable laws and regulations and acknowledge that misuse may result in termination of this Agreement and access to the Software.
- Permitted Uses: The Software is intended for lawful purposes only, including email marketing and communication within the terms of anti-spam and data privacy laws.
- Prohibited Uses: You may not:
- Use the Software to send unsolicited or unauthorized advertising (spam) or infringe upon third-party rights.
- Bypass or attempt to bypass security features within the Software.
- Misuse the Software in any manner that may harm or impair our Service, including distributing malware or other harmful code.
- Share login credentials or grant access to unauthorized parties.
4. Account Responsibility
You are responsible for maintaining the security of your account and all activity that occurs under your account credentials.

- User Accountability: You agree to be solely responsible for any actions performed under your account.

- Termination by HOME OF DW LTD: We reserve the right to terminate or suspend your access to the Software at our discretion, including if you violate this Agreement.
- Effect of Termination: Upon termination, your right to access and use the Software ceases immediately. Any data associated with your account may be deleted.
7. Disclaimer of Warranties
The Software is provided “as-is” and “as-available” without warranties of any kind, express or implied.
- No Warranty: We do not guarantee that the Software will meet your requirements, function without interruption, be error-free, or be free from security vulnerabilities.
- No Liability for Data Loss: HOME OF DW LTD is not responsible for any data loss or system failures due to the use of the Software.
8. Limitation of Liability
To the fullest extent permitted by law, HOME OF DW LTD and its affiliates, officers, employees, and agents shall not be liable for:
- Indirect Damages: Any indirect, incidental, or consequential damages, including lost profits, loss of data, or service interruptions.
- Total Liability: In any event, our liability is limited to the amount paid by you to access the Software during the twelve (12) months preceding the claim.
